Trabajo de grado - Pregrado
2021
The approach to testimonies of alleged child sex crimes should be based on forensic interview protocols that are organized in stages or phases in which verbal interventions by the interviewer are proposed. Research in psychology of testimony has identified appropriate and inappropriate types of questions, from technical scientific guidelines as a tool to recover the memory of events experienced by children and thus direct investigations for the legal clarification of the same. Therefore, the objective is to analyze the types of questions asked in the forensic interview to alleged victims of CSA. Method: From a descriptive observational approach, a theoretical and empirical review was carried out on the approach to the testimony of children and adolescents between 5 and 13 years of age, with the transcription of 10 audiovisual records made by CTI personnel, 4 of which were codified and analyzed from Grounded Theory. Results: The most frequently asked questions were yes-no (P-SN) 186R and hypothesis contrast (P-CH) 172R. Conclusion: The above may influence the occurrence of biases, and consequently, the best interests of the child and the objective decision making of the judge could be affected.
